Kaduna Tribunal orders PDP to serve Governor-elect via substituted means

The Kaduna State Governorship Election Tribunal, yesterday, granted a request by the Peoples Democratic Party’s (PDP), candidate, Isa Ashiru and the opposition party to serve the All Progressives Congress (APC) Governor-elect, Senator Uba Sani, court summon via a substituted means.

This followed a motion experte moved by the PDP and its candidate’s lawyer, 
Mercy Umar told the court that Senator Sani has been evading being serviced with court papers, challenging his victory in the Tribunal.

Citing relevant provisions of the law, she urged the Tribunal to grant her prayers to serve the governor-elect by substituted means.


Meanwhile, in the petition no: Ept/KD/Gov/4/2023 between Mohammed Ashiru Isa, PDP and Independent National Electoral Commission (INEC), Sani Uba and APC, the Tribunal granted the petitioners leave to effect service of the petition and all other subsequent processes on the 2nd Respondent in the petition via substituted service.

In his short ruling, the Tribunal Chairman, Justice V.O.A Oviawe granted the request and ordered that the Respondent, Sani be served by substituted means at the APC Secretariat, Tafida House, Kaduna.

Justice Oviawe also ordered that the Respondent should be served through any other means known by law; and also to be a proper mode of substituted service on the 2nd Respondent.

Besides, the Tribunal also granted similar requests by the three other political parties, who filed petitions against the Governor-elect, Sani.

It would be recalled that the Kaduna State Chairman of the PDP, Felix Hyat said despite the issuance of Certificate Of Return to Sen. Sani, his party would reclaim the mandate of the people through the court.

However, with this development, Sani has 21 days within which to file his response, thereafter, a date for pre-trial would be announced.
