Court asks Kashamu to execute rulings on extradition

Justice Okon Abang of the Federal High Court, Abuja yesterday told Senator Buruji Kashamu to go ahead and execute two previous court judgments he obtained, which stopped the Federal Government from extraditing him to the United States (U.S.) to face trial on hard drugs-related offences.

Justice Abang, in his ruling stated that it was not necessary for the Federal High Court to issue a fresh order against the defendants in the matter since the same court had delivered two judgments in his favour on the subject matter and that the two judgments have not been set aside by any superior court.

Senator Kashamu had premised his request on the ground that he had information that operatives of the police and the DSS were making moves to abduct and extradite him to the U.S.

In his motion on notice, filed by his counsel, Mr. Godswill Mrakpor, the senator claimed that unless the court grants him the injunctive order, his security would be put in jeopardy by the security operatives.

But Justice Abang said, “If he is apprehensive, and is so sure of himself and his fact that some people are planning his extradition, he is at liberty to execute the various judgments so as to stop the plan.

“The two judgments are still subsisting and therefore, the applicant requires no court order against the respondents.”

On the petition against him by Adebutu that he, Kashamu, was threatening his life, the judge ordered that status quo be maintained in the matter pending the determination of the motion on notice filed by the senator.

Justice Abang stated that his decision was based on the consent of the parties that they shall suspend action on life issue as it was before the court.

The judge, however, referred the case file to the chief judge of the court, Justice Ibrahim Auta, for reassignment to another judge after vacation.

He noted that his tenure as a vacation judge would end on September 9, and as such, he could not afford to open a fresh case he would not be able to finish.
