Court orders arrest of five investigating police officers in Kaduna

A Chief Magistrate’s Court in Kaduna State has ordered the arrest of five Investigating Police Officers (IPOs) for unlawful arrest and prosecution of a man.

The Chief Magistrate, Awwal Musa Aliyu, said the officers defied the court order that one Alabi Owoeye of the Anti-Corruption Initiative be arrested within 14 days for contempt.

But, Ibrahim Usman, was wrongfully arraigned in Sabon Gari Local Council Area, instead of Owoeye.


The affected IPOs are attached to the General Investigation Department (GID) Annex Alagbon, in Lagos State.

The IPOs are Superintendent of Police (SP) Fatai Adeniyi, DSP Kabiru Salami and Inspectors Jami’u Olaigbe, Amechi Augustine and Enechojo Jeremiah.

According to the court, the bench warrant was issued under section 7 of the Administration of Criminal Justice Law of Kaduna State, 2017.

“The person who now stands in the dock, as an accused person was unjustifiably arrested and arraigned before this honourable court. As rightly observed by the prosecution, the person to have been arraigned as an accused person is Owoeye, a member of an organisation known as Anti-Corruption Initiative.

“He is the one who blew the whistle wrongly by giving false information to the police to the effect that the nominal complainant allegedly illegally stockpiled arms and ammunition in his residence at G.R.A, Sabon-Gari, Zaria, Kaduna State. The information turned out to be false in its entirety, based on the search conducted at the premises of the nominal complainant,” the magistrate said.

The court further stated that: “When a search was conducted, no arms, ammunition or anything incriminating was found. The person who is now wrongfully was just the security guard at the premises of the nominal complainant.”

The magistrate added that contempt proceedings might be initiated against the police officers, if they fail to comply with its order to arrest Owoeye.
